These General Terms and Conditions of Contract and Sale regulate the relationship between HOME DEVELOPMENTS LT, S.L., owner of the online store operated under the trade name HOME CLIMATE COATINGS, and any natural or legal person that purchases products through the website.

For the purposes of these conditions, the term Seller designates HOME DEVELOPMENTS LT, S.L., and the term Buyer or Customer designates the person who purchases products through the website.

2. Purpose

This document regulates electronic contracting for products offered in the online store, including, among others:

  • thermal-insulating paints,
  • thermal-insulating coatings,
  • technical mortars and plasters,
  • primers and auxiliary products,
  • application accessories and complements,
  • technical documentation and material associated with products.

These conditions are intended to clearly establish the purchase procedure, delivery, application, warranties, returns, limitations of liability and other matters related to online sales.

3. Acceptance of Conditions

Making an order implies reading, understanding and full acceptance of these conditions. Before confirming the purchase, the Customer must particularly review:

  • the product technical data sheet,
  • the safety data sheet, where applicable,
  • indicative yield and consumption,
  • the substrate or application surface,
  • use conditions,
  • technical limitations of the product.

Confirmation of the order is equivalent to an express statement of knowledge and acceptance of these conditions.

4. Commercial Information and Technical Nature of Products

Products marketed by Home Climate Coatings are of a technical nature and, in certain cases, require specialized application.

Images, descriptions, videos, yields, test results, thermal reflection percentages, use recommendations and other informative content published on the website are for informative, commercial and explanatory purposes. Such content does not replace the technical data sheet, the safety data sheet or, where applicable, professional assessment by the applicator, architect, technician or installer.

The Customer acknowledges that the final result of application may be influenced by factors such as:

  • condition of the substrate,
  • moisture of the wall,
  • applied thickness,
  • climatic conditions,
  • application method,
  • prior substrate preparation,
  • ventilation and use of the property.

5. Purchase Process

The purchase process develops according to the following phases:

  • product selection,
  • adding to cart,
  • entering shipping and billing information,
  • final order review,
  • acceptance of these conditions,
  • payment confirmation,
  • sending order confirmation by the Seller.

The order shall not be considered concluded until the Seller issues the corresponding confirmation.

The Seller may refuse or cancel any order when there are reasonable indications of material error, fraud, system abuse, lack of stock, logistical impossibility or any other objectively justified reason.

6. Prices, Taxes and Invoicing

All prices are expressed in euros.

Prices may be presented with separate or included indication of applicable taxes depending on the delivery destination and corresponding tax regime.

In case of deliveries to the Canary Islands, Ceuta, Melilla or other territories with special tax regimes, applicable taxation may differ from that corresponding to mainland Spain.

Shipping costs, handling, special packaging, palletization or additional services will be shown, where applicable, before completing the purchase.

The Customer consents to the issuance of electronic invoice unless expressly stated otherwise when regulations permit.

7. Product Availability

Publication of a product in the online store does not imply permanent availability. In case of lack of stock, the Seller may:

  • communicate a new estimated delivery time,
  • offer an equivalent product,
  • proceed to refund the amounts paid for the unavailable product.

8. Delivery, Transport and Risk

The Seller will make shipments to destinations enabled on the website, including Tenerife, the other Canary Islands, mainland Spain and other destinations expressly indicated.

Delivery times are indicative and may vary due to logistical, seasonal or circumstances beyond the Seller’s control.

Risk of the product will be transferred to the Customer in accordance with applicable regulations on distance sales and delivery of goods.

The Customer must check the condition of the packaging and contents upon receipt. Any visible incident must be noted on the transport receipt or immediately communicated to customer service.

9. Specific Conditions of Technical Products

Home Climate Coatings products generally require strict compliance with their technical data sheet. The Customer expressly accepts that:

  • the choice of the appropriate product depends on the type of substrate and the problem to be solved,
  • substrate preparation is essential for the result,
  • the number of coats, thickness and application method directly influence the final system behavior,
  • the yields indicated are indicative and may vary depending on substrate absorption and application conditions,
  • any modification of the application system outside what is indicated in the technical documentation may affect the result and warranty coverage.

When the product requires priming, intermediate drying, prior mixing, dilution or particular application conditions, such instructions form an essential part of correct product use.

10. Obligation for Prior Technical Review

Before purchasing and, in particular, before applying any product, the Customer must read the technical data sheet, the safety data sheet and the application recommendations.

If the Customer is unaware of the substrate type or technical conditions of his or her property, it is recommended to seek prior advice.

The Seller shall not be responsible for consequences arising from incorrect product selection by the Customer when such selection has been made without regard to available technical information.

11. Payment Methods

Available payment methods will be shown during the purchase process. The Seller may enable, limit or modify accepted payment methods at any time. Order confirmation may be subject to correct payment validation by the corresponding entity.

12. Right of Withdrawal

When the buyer has consumer status, he or she shall have the legal right of withdrawal under the terms established by applicable regulations.

Withdrawal must be exercised within the legal period, by express communication directed to the Seller’s contact email.

The Customer shall be responsible for returning products in adequate condition, unless the law provides otherwise.

13. Exceptions to Withdrawal

Without prejudice to inalienable consumer rights, withdrawal shall not apply to those cases legally excluded, including, where applicable:

  • products customized according to consumer specifications,
  • clearly personalized products,
  • opened or manipulated products when their nature prevents their re-commercialization in adequate condition,
  • other cases provided for in consumer protection regulations.

When a product has been tinted, prepared or altered at the specific request of the Customer, such circumstance may affect the possibility of return, to the extent permitted by applicable regulations.

14. Returns

Any return must be previously authorized by customer service. Returns will not be accepted for products:

  • used,
  • damaged by improper handling,
  • incomplete,
  • without original packaging,
  • whose nature prevents their resale under normal conditions, except for legal obligation to the contrary.

Return costs shall be governed by applicable regulations and by what is indicated on the page Shipping and Returns.

15. Legal Warranty

Products marketed benefit from the legal warranty applicable under consumer and user protection legislation. The warranty shall not cover in any case defects or damages caused by:

  • incorrect application,
  • inadequate substrate,
  • lack of cleaning, priming or preparation,
  • failure to comply with drying times,
  • inadequate environmental conditions,
  • use contrary to the technical data sheet,
  • improper storage,
  • intervention by unauthorized third parties,
  • normal wear and tear,
  • accidents or external causes.

The warranty does not constitute a promise of identical results in all properties. The final system behavior will depend on the specific conditions of the project and its correct execution.

16. Claims and Incidents

The Customer must communicate any incident at the earliest opportunity, including the following information:

  • order number,
  • full name,
  • photographs or video,
  • detailed description of the incident,
  • application date,
  • batch reference, where it exists,
  • basic information on the substrate and application method.

The Seller may request additional information or technical inspection of the case to properly assess the claim.

17. Liability

The Seller shall not be liable for damages or losses arising from:

  • misuse of the product,
  • application outside specifications,
  • improper handling,
  • inadequate storage,
  • decisions made without review of technical documentation,
  • delays or transport incidents beyond the Seller’s control,
  • force majeure or act of God.

The Seller’s liability shall be limited, to the extent permitted by law, to the amount actually paid for the product subject to the claim, without prejudice to inalienable consumer rights.

18. Intellectual and Industrial Property

All website content, including texts, photographs, images, videos, graphics, logos, trade names, technical data sheets, catalogs and designs, is protected by intellectual and industrial property rights. Reproduction, distribution, transformation or exploitation is prohibited without express written authorization from the owner, except for uses permitted by applicable legislation.

19. Personal Data Protection

Personal data provided by the Customer shall be processed in accordance with the Privacy Policy published on the website. Submission of forms, orders, queries or subscriptions implies processing of data to the extent necessary to address the contractual, pre-contractual or informational relationship requested.

20. Cookies

The website uses own and third-party cookies for technical, analytical and, where applicable, personalization or marketing purposes. Consent management is regulated in the Cookie Policy, where the user may accept, reject or configure cookies clearly and equivalently.

21. Modification of Conditions

The Seller may modify these conditions at any time. Modifications shall not affect already confirmed orders, unless mandatory regulations provide otherwise.

22. Partial Nullity

If any clause of these conditions is declared null, invalid or inapplicable, this shall not affect the validity of the rest of the document, which shall remain fully in force. The affected clause shall be interpreted or supplemented in the manner most closely aligned with the original economic and legal intent.

23. Applicable Law and Jurisdiction

These conditions are governed by Spanish law. In case of conflict, and when the buyer has consumer status, the courts and tribunals competent under consumer protection regulations shall be competent.
